Britney Spears’ Request To Toss Father From Conservatorship Denied!

Britney Spears’ request to move up a hearing to have her father tossed from the conservatorship was DENIED by the judge overseeing the case.

According to new legal documents, obtained by The Blast, Britney’s request to have the discussion of removing her father done ASAP has been denied and she will now have to wait until September. In the filing, Britney’s request to have her dad suspended as conservator until the hearing was also denied.

As for why…no specific reason was given for the denial…but it was “without prejudice” which essentially means she can bring it up again in the future. We are guessing the judge didn’t see it as an emergency per se and believes the issue can be discussed on the original date it was set for in the courts.

As we reported, Britney was sick of waiting for Jamie Spears to be booted from the conservatorship and had her legal team file documents asking for it to be argued in August. Britney’s lawyer, Mathew Rosengart, quoted her current conservator — Jodi Montgomery — essentially saying every day that goes by is traumatizing for the pop star.

“Mr. Spear’s removal as conservator is critical to [Britney’s] emotional health and well-being and in the best interest of [Brintey,] the document stated. Adding, “I have had numerous, ongoing conversations with the medical team and we all agree that it would be best for Ms. Spears’ well-being and mental health that her father stop acting as Conservator.”

He continued, “every day that passes is another day of avoidable harm and prejudice to Ms. Spears and the estate.”

Britney’s lawyer made it clear that he believes the current situation is also terrible for her financial health. “There has been an evident dissipation of assets of Ms. Spears Estate, and that dissipation is ongoing,” he wrote. Rosengart claims one of Jamie’s lawyers alone is asking for more than $1.3 million in attorney’s fees. Plus, Jamie submitted an invoice to Britney’s accounts for $541,000 in “media matters.” Not to mention, the hundreds of thousands of dollars a year that Jamie is paid to be Britney’s conservation — something they believe is not necessary.

Interestingly, Rosengart used a quote from Britney’s mother — Lynne Spears — saying, “It is clear to me that James P. Spears is incapable of putting my daughter’s interests ahead of his own on both a professional and a personal level.”

At this point, Britney hasn’t officially filed documents to remove the entire conservatorship — in fact, she has agreed to keep Montgomery on board for the time being…but she really wants her father out!

In the end, it appears the judge has left the door open for Britney’s lawyer to re-file the motion, but we are guessing he will have to be more specific on the damage it is having on the pop star on an emergency level. If not, the situation will be argued at the upcoming hearing in September. As for which way the judge may go, Britney’s doctors have agreed the father/daughter relationship is unhealthy for the pop star, so we are guessing Jamie’s time being involved is limited.
